Landlord Legal Obligations for Gas and Boilers

Annual Gas Safety Check (CP12)

Landlords must arrange a gas safety check every 12 months by a Gas Safe registered engineer. A copy of the record must be given to existing tenants within 28 days and to new tenants before they move in.

Duty to Repair

Under the Landlord and Tenant Act 1985, landlords are responsible for maintaining heating and hot water installations in working order. Tenants can report disrepair to the local council if landlords fail to act.

Reasonable Response Times

In winter months, heating failures should be treated as urgent (24–48 hours). In summer, a week is generally considered reasonable for non-emergency repairs.

EPC Requirements

Rental properties must have an EPC rating of at least E. Properties with an F or G rating cannot be let to new tenants (and since 2023, to any tenants). An efficient boiler can dramatically improve an EPC rating.
